Deirdre O'Keeffe Photography offers photography related services.

 

Contract of use

This contract is agreed between DOK Photography ("The Photographer") and the Person or Persons ("the Client") purchasing the services and the Person and/or Persons who are subjects in the photographs. If you choose to use our Services, then you agree to the terms stated within this document. The Personal Information that we collect are used for providing and improving the Service only and is never shared with any third party.

A session fee is required to confirm a photographic shoot. This fee must be paid in advance of the shoot in order to confirm a booking.

Shoot fees are not refundable outside exceptional circumstances.

 

When ordering photographs, a 50% deposit must be paid at time of ordering. The balance is payable on delivery.

 

The Photographer takes no responsibility for issues relating to the printing of digital items by the Client or the Client’s agents. Digital items may vary in size due to cropping. The Photographer normally guarantees print size from digital images up to 20 inches on the long side. The Buyer understands and accepts that cropping may reduce this size.

 

Post production is performed by The Photographer on all purchased images. Small blemishes are normally removed and any reasonable corrections are made at no extra charge. Colour correction, conversion to black and white and contrast corrections are all included. The Photographer strives to produce images of the highest quality at all times and will make any reasonable effort to create a quality image. 

In the unlikely event that intensive manipulation is required, the Client understands and accepts that this labour intensive process is available at an additional fee as it is possible to spend several hours or even days manipulating (“photoshopping”) a single image.

In the unlikely event of any complaints, the Client should raise the issue in writing within 21 days from the date of receipt of images. In the unlikely event of an unresolved complaint the Client may request the Irish Professional Photographers Association to mediate but only on the basis that its decision shall be final and binding upon both parties.

The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control as in force majeure or Act of God or the event of a total photographic failure. Under these circumstances, neither party shall be liable for indirect or consequential loss.

 

Copyright of all images taken remains with The Photographer at all times. Commercial use of any images supplied by The Photographer is prohibited without prior consent.. The Photographer reserves the right to use any of the images captured during the shoot for promotional purposes. This includes usage for web site, portfolio, competitions, literature, display areas, exhibitions, advertising or any other manner for DOK Photography commercial and promotional purposes. The Photographer respects your privacy and will observe the 'Opt-In' section of the booking form for this purpose. Please see our Privacy Policy for more information.

Archiving & Digital Image Access 

The Photographer will make every reasonable effort to handle all digital photographs both during and after the event on a minimum of two  separate digital storage units simultaneously. This limitation of liability also applies to any loss or damage of photographs, or failure to deliver photographs for any reason. Upon receipt of the digital media, both physically or online, the Client accepts all responsibility for archiving and protecting the photographs.

 

The Photographer is obliged to archive images for 1 year from the date of the delivery of files. The Photographer is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read the digital media provided. It is the Client's responsibility to make sure that digital files are copied to new media as required.

 

Digital links will remain online and accessible for 30 days from date of issue. After this date a processing fee of €20 applies to set up a new downloadable link.
